Why Courts Don’t Know What to Do About AI Crimes (And How to Fix It)

The New Age of Digital Deception

Just a few months ago, a deepfake video of a prominent Indian actress went viral, sending shockwaves across the nation. It was a stark, uncomfortable reminder that we’ve entered a new era—one where reality can be convincingly manufactured by an algorithm. While the incident sparked outrage, it also exposed a gaping hole in our justice system: courts don’t know what to do about AI crimes because the laws they uphold are dangerously unprepared.

Our Legal System Can’t Keep Pace with Technology

The fundamental problem is one of speed. Our legal framework, built on the solid bedrock of the Indian Penal Code and the Information Technology Act of 2000, moves at the pace of parliamentary debate. AI, on the other hand, moves at the speed of light. The IT Act, drafted for an era of dial-up modems and email fraud, is simply not equipped to handle crimes orchestrated by generative AI that can clone a voice from a three-second clip or create photorealistic images from a text prompt.

When a crime is committed, our legal system asks two basic questions: who did it, and how can we prove it? AI throws a wrench into both, leaving the judiciary in uncharted territory.

The Accountability Problem: Who Is to Blame for an AI Crime?

Imagine an AI-powered financial scam that dupes a senior citizen out of their life savings using a perfect voice clone of their grandchild. Who is the culprit? Our legal system struggles to answer this critical question. Is it:

  • The person who typed the malicious prompt?
  • The developers who created the AI model without adequate safeguards?
  • The company that hosted the AI on its platform?
  • The increasingly autonomous AI itself?

Our laws are built around the concept of human intent (mens rea). They are designed to prosecute a person, not a complex, non-sentient algorithm. A judge cannot issue a warrant for the arrest of a large language model. This legal ambiguity creates a perfect storm where accountability becomes a game of passing the buck, leaving victims with little to no recourse.

The Evidence Conundrum: Can We Believe What We See?

The second major challenge for courts is evidence. The digital breadcrumbs left by AI are unlike anything forensic experts have dealt with before. How do you prove, beyond a reasonable doubt, that a piece of evidence—a video, an audio clip, or a document—was AI-generated?

While technologies like digital watermarking are being developed, sophisticated AI can also learn to erase or mimic these markers. This creates a forensic nightmare. A courtroom drama of the future might not feature a “smoking gun” but duelling experts arguing over the statistical probability of an image’s pixel distribution. This uncertainty makes it incredibly difficult for judges and juries to reach a fair verdict.

The Way Forward: Modernizing Justice for the AI Era

The digital ghost is out of the machine. It’s creating art, writing code, and, unfortunately, committing crimes. For a country like India, with its massive digital population, the stakes are incredibly high. The recent advisory from the Ministry of Electronics and Information Technology (MeitY) asking platforms to label AI-generated content is a step, but it’s a bandage on a wound that needs surgery.

To truly address why courts don’t know what to do about AI crimes, we need a multi-pronged approach:

  1. New Legislation: We urgently need a new legislative framework, perhaps as part of the proposed Digital India Act, that specifically defines AI-related offences and establishes clear lines of liability for developers, platforms, and users.
  2. Judicial Training: We must invest in training judges, lawyers, and law enforcement officials to understand the nuances of AI. The creation of specialised techno-legal benches to handle such complex cases could ensure that justice is both informed and swift.

Right now, AI haunts the halls of justice as a phantom our legal system can’t see, let alone prosecute. If we don’t act swiftly to update our laws and empower our courts, we risk becoming a nation where the most sophisticated criminals are not people, but programs.
